On April 22, 2010, a new law governing renovations in houses that contain lead paint became effective.  Aimed at protecting against lead-based paint hazards, the EPA’s new rule applies anytime a lead paint surface is disturbed by renovation or painting projects, including repairs, maintenance, electrical, plumbing, carpentry, demolition, and window replacement. The rule also requires remodeling and renovation firms to be certified by the EPA, and that they assign at least one EPA Certified Renovator to the job to ensure that lead-safe work practice standards are observed.

There are a few exclusions to the rule, such as activities that disturb less than six square feet of a painted interior surface, or less than 20 square feet on a painted exterior wall. However, any work that involves window replacement, demolition of painted surfaces and/or building components, or "restricted practices," such as using a machine sander is subject to the new regulations.

 

The rule applies to all professional renovations done in housing and child-occupied facilities built before 1978. EPA has the authority to seek civil fines of $32,500 per offense for failure to comply with the Rule’s requirements. EPA can also seek criminal fines of $32,500, plus potential jail time for violations of the new requirements.
